Question: My spouse was born in Germany. She currently works on a H4 Employment Authorization Card. Can her employer sponsor her for a green card even though she is working on H4 EAD through my EB-2 category Green card?

 

Answer: Yes, she can be sponsored for a visa independently of you. What will happen is that the immigration lawyer that does her paperwork will include a new EAD application based on her own employment-based visa category. This will also end her H4 status since her staying in the US will no longer be dependent on your employment.
